DISCLOSURE — READ BEFORE SUBMITTING THIRD-PARTY ADD-ONS

By submitting code to this forum, you’re confirming it’s your own work (or you have permission to publish it), that it’s fully open-source with no compiled/protected components, and that you’re submitting it in the required export format. NinjaTrader, LLC takes no responsibility for the code’s performance or for any live-account authorization needed to use it. Read the full terms below.

Section 1: Submission Requirements & Content Ownership

1. You must only post NinjaScript code that you personally created, or that you have full permission and authorization to publish publicly. If you are not the original author, you must accurately identify the original developer/creator/author.
2. Submissions must be source-only NinjaScript, fully disclosed and unprotected — no compiled, obfuscated, or otherwise protected code.
3. Submissions must be in the NinjaScript Archive File (.zip) format, generated via File > Utilities > Export NinjaScript.
4. You must not post protected files (DLLs), or any NinjaScript code that references external DLLs.
5. NinjaTrader, LLC reserves the right to remove any submission, for any reason, at any time.
6. You must not post code that infringes the rights of any third party (including intellectual property rights), or that is defamatory, abusive, or offensive. Violating this provision will result in the loss of all privileges to participate and contribute to this forum, in addition to the indemnification obligations described below.

Section 2: Live Trading & FCM Authorization Requirements

7. You must not connect, run, or deploy any code from this forum to a live trading account unless your account has been explicitly enabled for automated/algorithmic order entry by your Futures Commission Merchant (“FCM”). Enabling API or automated trading access is a separate authorization from standard trading permissions and must be granted directly by your FCM.
8. You must only route live orders generated by this code through accounts have completed any FCM-required pre-trade risk controls (including, but not limited to, maximum order size, maximum position, and fat-finger/velocity limits) consistent with your FCM’s risk management obligations under CFTC and NFA rules.
9. If the code submits orders directly to an exchange (e.g., CME) rather than through manual entry, you are responsible for confirming that your FCM has completed any required exchange algorithmic registration (such as a CME Algo ID / Tag 50 designation) before the strategy is used in a live environment.
10. Your FCM may require independent testing, conformance review, or sign-off on automated strategies before authorizing live deployment. NinjaTrader, LLC’s export/import of NinjaScript files does not constitute, and is not a substitute for, any such FCM authorization.
11. You must not represent, imply, or warrant that any code posted or shared in this forum has been reviewed, approved, or authorized by any FCM, clearing firm, or exchange. NinjaTrader, LLC makes no such representation either. All such authorizations remain solely the responsibility of the account holder and their FCM.

Section 3: Indemnification & Limitation of Liability

By submitting, downloading, installing, or using any code posted in this forum, you agree to fully indemnify and hold harmless NinjaTrader, LLC and its affiliates from and against any and all claims, losses, liabilities, and expenses arising from or related to:

• any inaccuracy in your representations regarding authorship or authorization to publish (Section 1, Item 1);
• any infringement, defamatory, abusive, or offensive content you post (Section 1, Item 6);
• your download, installation, or use, in whole or in part, of any code available in this forum; and
• your use of any code from this forum on a live trading account, including any failure to obtain, verify, or maintain required FCM-level trading authorization, risk controls, or algorithmic registration.

NinjaTrader, LLC and its affiliates bear no responsibility for obtaining, verifying, or maintaining any FCM-level authorization, risk control, or registration required for code from this forum to be used in a live environment.
